If your request for NDIS access is denied, or your plan does not include the supports you need, you can ask the NDIA to review its decision. This is called an internal review or section 100 review.
The request needs to be submitted within 90 days of the original decision date. The decision date can be found on the letter you receive from the NDIA, normally in the top left of the first page.
When you submit your request to the NDIA, you can include documents that you have already submitted as well as new evidence. You can explain to the NDIA what decision you were expecting and why the NDIA should make a different decision.
The NDIA aims to respond to your internal review request within 60 days.
If you are still not satisfied with the outcome from the internal review, you can apply for an external review to the Administrative Review Tribunal.
The role of the Administrative Review Tribunal (ART) is to conduct independent reviews of decisions made by government agencies. The ART’s job is to consider the NDIA’s decision on its merits. This means the ART will take a fresh look at the facts, law and policy relating to the decision and consider any new information you submit.
You can submit an application for review to the ART within 28 days of receiving your internal review response from the NDIA.
There will be opportunities to lodge further evidence throughout the ART appeal process. The NDIA needs three weeks to look at new evidence
Our NDIS Appeals advocates may be able to assist those going through the ART process after an application to the ART has been made.
We aim to provide information and guidance to help you and your support networks understand the ART process.
Advocates can
- Provide information sessions about the ART process as a whole or any part of the process.
- Review reports and documents from professionals.
- Assist in writing a statement of lived experience.
- Advise on responses to information requests or offers to resolve
- Prepare for and/or attend a case conference
- Obtain legal advice on your behalf
- Assist you to understand and comply with the Directions from the Tribunal
